Online Division Order Certificate Program: Module 3 of 6 - Land and Leasing / Instructor Alyce Hoge

The required text is the NADOA Study Guide, which is $75 (one-time charge). Students need to join NADOA for $75 to download the "no cost" manual only available to members.

Course cost includes a $13.50 Distance Learning Fee.

Module 3 provides a focus on the oil and gas lease, often described as the cornerstone contract of oil and gas exploration. Without it, oil and gas companies would be unable to enter the land of the mineral owner. That is, the lease itself grants "permission" to the oil and gas company to develop the mineral interest. As such, the oil and gas lease and its specific provisions will be examined in detail by utilizing a Sample Lease Guide identifying key provisions, including terminology and intent. A specific focus will be given to the Pooling provision via a separate webinar in Week 3. We will also study common terminology used in interest calculations including working interest, leasehold interest, net revenue interest, overriding royalty interest and gross and net acres. These terms will be applied via online tutorials covering Interest Calculation problems. Finally, we review the critical skill of analyzing an oil and gas lease to ensure compliance with contractual obligations and avoidance of potential lawsuits for breach.

By the end of Module 3, students will be able to:
• Understand the provisions of an oil and gas lease including the Mother Hubbard, Habendum, Force Majeur and Savings Clauses
• Analyze an Oil and Gas lease
• Understand Common Amendment to the Lease
• Understand State Spacing Requirements
• Distinguish Between Pooling & Unitization
• Understand Post Production Costs
• Calculate Rental Payments
• Calculate Bonus Payments
• Calculate Shut-In Royalty Payments
